Forrest Paddle Boarding Waiver & Release of Liability Form

In consideration of Forrest Paddle Boarding furnishing services and/or equipment that enable me to participate in Paddle Boarding or kayaking I agree as follows:I hereby RELEASE AND DISCHARGE Forrest Paddle Boarding, their employees, instructors, their agents, subdivisions, sponsors, advertisers, other participants, lessors of premises, land and dock owners, (hereinafter collectively referred to as “Released parties”), from any and all liability, claims, demands or causes of action that I may hereafter have for injuries/damages arising out of my participation in Stand-Up Paddle Boarding activities, including, but not limited to, losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the released parties for damages or other losses sustained as a result of my participation in Stand-Up Paddle Boarding activities. I also agree to indemnify and hold the released parties harmless from all claims, judgements and costs, including attorneys’ fees, incurred in connection with any action brought as a result of my participation in Stand-Up Paddle Boarding activities.I fully understand and acknowledge that Stand-Up Paddle Boarding activities have inherent dangers that no amount of care, caution, instruction or expertise can eliminate and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN STAND-UP PADDLE BOARDING ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF RELEASED PARTIES.I understand the inherent risks associated with Stand-Up Paddle Boarding and water sports such as but not limited to changing water flow, currents, motor boat’s wake, collision with other participants or natural or man-made objects, wind shear, inclement weather, lightening, variances in wind, weather or temperature, exposure, fatigue, chill, heat or sun related injury, wildlife, marine life, insects, danger of collision or capsizing, risk of drowning and I am willing to take full responsibility for any harm or discomfort that occurs during or after participation.I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, associated with Stand- Up Paddle Boarding EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERS, and assume all responsibility for my participation. I am physically and mentally fit and not under the influence of any medicines, substances or drugs (legal or illegal) that will impair my judgement or ability. I will operate Stand-Up Paddle Boarding equipment in a reasonable and safe manner so as not to endanger my life, the lives of others, or the property of any individual or business. I will wear my life jacket in accordance with the law. I realize that I am responsible for returning any equipment in a timely manner and in good condition. I FULLY UNDERSTAND THAT I AM RESPONSIBLE FOR ANY DAMAGES/LOSSES THAT OCCUR TO EQUIPMENT whether or not it is due to my neglect or negligence and will make compensation according to Forrest Paddle Boarding guidelines. I willingly agree to comply with the terms and conditions for participation. If I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring it to the attention of the nearest official immediately.I further represent that I am at least 18 years of age, or that as the parent or (adult) legal guardian, I waive and release any and all legal rights that may accrue to me, to my minor child or to the minor child for whom I am the (adult) legal guardian, as the result of any injury that my minor child, the minor child for whom I am (adult) legal guardian, or I may suffer while engaging in Stand-Up Paddle Boarding activities.I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS FORREST PADDLE BOARDING and all Released parties.
